  1. Acceptance of Terms

By accessing this website or engaging EverCare Nursing & Support Pty Ltd (“EverCare”, “we”, “our”, or “us”) for services, you agree to be bound by these Terms & Conditions.

  1. Our Services

EverCare Nursing & Support Pty Ltd provides Registered Nurse-led nursing and disability support services, including but not limited to:

  • Registered Nursing Services
  • Medication Management
  • Wound Care
  • Diabetes Management
  • Continence Care
  • Health Education
  • Personal Care
  • Disability Support
  • Community Access
  • Shopping Assistance
  • Meal Preparation
  • Household Assistance
  • Transport Assistance
  • Wellness Checks
  • Nursing Support (where appropriate) 
  1. Eligibility for Services

Services are available to:

  • NDIS Participants
  • Self-funded clients
  • Privately funded clients
  • Clients referred by healthcare professionals or authorised representatives

We reserve the right to determine whether our services are appropriate for each individual.

  1. Service Agreements

Where required, clients will enter into a Service Agreement outlining:

  • Services to be provided
  • Frequency of support
  • Pricing
  • Responsibilities of both parties
  • Cancellation terms
  • Payment arrangements

The Service Agreement takes precedence over these general Terms where applicable.

  1. Fees and Charges

All fees are charged in accordance with:

  • Current NDIS Pricing Arrangements and Price Limits (where applicable)
  • Agreed private service rates
  • Individual Service Agreements

Additional charges may apply for:

  • Travel
  • Parking
  • Toll fees
  • Consumables
  • After-hours services (if applicable)
  1. Travel Charges

Travel charges may include:

  • Worker travel (per kilometre where applicable)
  • Parking fees
  • Toll charges

These costs will be discussed and agreed with the participant before services are provided.

  1. Appointments and Cancellations

Clients are requested to provide at least 24 hours’ notice if an appointment needs to be cancelled or rescheduled.

Late cancellations or missed appointments may incur cancellation fees in accordance with:

  • NDIS Pricing Arrangements
  • Individual Service Agreement

EverCare reserves the right to reschedule appointments where necessary.

  1. Client Responsibilities

Clients agree to:

  • Provide accurate information
  • Treat staff respectfully
  • Maintain a safe environment
  • Notify us of changes to health conditions
  • Inform us of changes to contact details
  • Provide access to the service location
  • Pay invoices within agreed timeframes (where applicable)
  1. Our Responsibilities

EverCare is committed to:

  • Providing respectful and person-centred care
  • Protecting client privacy
  • Delivering services safely
  • Employing qualified staff
  • Maintaining professional standards
  • Complying with Australian legislation
  • Respecting participant choice and control
  1. Health and Safety

Our staff have the right to work in a safe environment.

Services may be suspended or ceased where:

  • Staff safety is at risk
  • Violence or threatening behaviour occurs
  • Unsafe working conditions exist
  • Illegal activities are present
  1. Privacy

Your personal information is handled in accordance with our Privacy Policy and Australian Privacy Laws.

By using our services, you consent to the collection and use of your information for service delivery.

  1. Website Use

You agree not to:

  • Misuse the website
  • Attempt unauthorised access
  • Introduce malicious software
  • Copy website content without permission
  • Use the website for unlawful purposes
  1. Limitation of Liability

  1. Referrals

Referrals may be submitted by:

  • Registered Health Professionals
  • General Practitioners
  • Hospitals
  • Support Coordinators
  • Family Members
  • Carers
  • Participants

Submission of a referral does not guarantee acceptance for services.

  1. Confidentiality

All client information will be treated confidentially except where disclosure is:

  • Required by law
  • Necessary for service delivery
  • Authorised by the client
  • Required to prevent serious harm
  1. Complaints and Feedback

EverCare values feedback and aims to resolve concerns promptly.

Complaints may be submitted by:

  • Email
  • Telephone
  • Written correspondence

Where a complaint cannot be resolved internally, clients may contact the NDIS Quality and Safeguards Commission or another relevant authority.

  1. Changes to These Terms

We reserve the right to amend these Terms & Conditions at any time.

The latest version will be published on our website and becomes effective upon publication.
